By accessing and using the services provided by BrandBoulevard Studios (“we,” “us,” “our”), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. Services Provided
BrandBoulevard Studios offers the following services:
- Logo Design
- Web Design and Development
- Graphic Design
- Social Media Design
- Online Presence Setup
- Online Marketing
- Content Creation
These services are subject to change, and we reserve the right to modify or discontinue any of the services at any time without prior notice.
3. User Responsibilities
When engaging with our services, you agree to:
- Provide accurate and complete information.
- Ensure that any material you provide does not violate the rights of third parties.
- Comply with all applicable laws and regulations.
You are solely responsible for any content or material that you submit or transmit while using our services.
4. Payments and Fees
All payments for services are accepted through the following methods:
- M-Pesa
- PayPal
Payment terms are as follows:
- A 50% deposit is required upfront before any design or project work begins.
- The remaining 50% is due upon project completion, prior to the delivery of final design files.
Refunds will not be issued for work already completed. If the project is canceled before work has commenced, clients may be eligible for a partial refund of the deposit.
If payments are not received within the agreed-upon timeline, we reserve the right to delay or suspend the delivery of services.
5. Intellectual Property Rights
All intellectual property rights in the content and materials provided by BrandBoulevard Studios, including but not limited to logos, web designs, graphics, and other works, remain the property of BrandBoulevard Studios unless otherwise agreed in writing.
Upon final payment, clients will receive the rights to the final design files. However, BrandBoulevard Studios reserves the right to display completed projects in our portfolio and marketing materials.
6. Client Revisions
We strive to ensure our designs meet client expectations. Revisions may be requested as follows:
- Clients are entitled to 3 revisions during the design process at no additional cost.
- Additional revisions beyond the agreed amount may incur extra fees.
7. Limitations of Liability
To the extent permitted by law, BrandBoulevard Studios shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from the use of our services.
We are not responsible for any delays caused by clients’ failure to provide necessary feedback, materials, or approvals in a timely manner.
8. Termination of Service
We reserve the right to terminate or suspend your access to our services at any time without notice if you violate any of these Terms. Upon termination, any unpaid amounts for services already rendered will remain due.
9. Privacy Policy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts in [insert location].
